1. Agreement to these terms
By accessing or using afclaims.com (the “Site”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site.
These Terms govern use of the website. They are separate from any written public adjusting contract you may later sign with American Financial Claims.
2. Not an attorney; not legal advice
American Financial Claims is a licensed public adjusting firm. We are not a law firm. Nothing on this Site is legal advice, and nothing here creates an attorney-client relationship.
Content on the Site — including articles, checklists, claim tips, the book “The Insurance Game — And How To Win It,” tools, and FAQs — is educational and general. It may not apply to your policy, property, or state.
3. No PA-client relationship from browsing or forms
Browsing the Site, submitting a form, using chat, downloading a book, scheduling a consult, or speaking with us informally does not create a public-adjuster / client relationship and does not hire AF Claims.
Engagement begins only when both parties sign a written public adjusting contract that describes the services, fees, and property/claim to be handled.
4. No guarantee of results
We do not guarantee any settlement amount, coverage decision, timeline, or outcome. Past recoveries described on this Site (where authorized) do not predict results for your claim. Every matter depends on the policy, facts, documentation, and the carrier’s position.
5. Licensing and geographic limits
Public adjusting services are offered only where we are properly licensed and authorized. Florida firm license G288962 · NPN 21769471. Individual credentials and additional state licenses appear on our Licensing page. We may decline matters outside our licensed footprint.
6. Acceptable use
You agree not to misuse the Site — including by submitting false information, attempting unauthorized access, scraping in a way that harms the Site, or using the Site for unlawful purposes.
7. Intellectual property
Site content, branding, and materials are owned by American Financial Claims or its licensors. The book “The Insurance Game — And How To Win It” remains copyrighted by the author/publisher as applicable. You may not republish Site content for commercial use without permission.
8. Third-party links and tools
The Site may link to third-party sites or embed tools (for example scheduling or maps). We are not responsible for third-party content, privacy practices, or availability.
9. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, American Financial Claims and its owners, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site. Our aggregate liability for Site-related claims is limited to one hundred dollars ($100) or the amount you paid us (if any) specifically to use the Site in the twelve months before the claim, whichever is greater. These limits do not affect rights under a signed public adjusting contract.
11. Indemnity
You agree to indemnify and hold harmless American Financial Claims from claims arising out of your misuse of the Site or your violation of these Terms, to the extent permitted by law.
12. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue for disputes relating to the Site lies in state or federal courts located in Miami-Dade County, Florida, unless a signed contract says otherwise.
13. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after an update means you accept the revised Terms.
