Why Acuity claims get denied or underpaid

General reasons homeowners report for denied or short-paid claims, with any carrier (not a description of Acuity’s internal rules):

Hail damage called cosmetic

Dents in metal roofing, gutters or siding are sometimes treated as cosmetic, and some policies carry endorsements that limit cosmetic hail damage. Read the endorsement, then document functional damage such as fractured shingle mats, granule loss and cracked tiles.

Wear and tear vs. storm damage

Older roofs are often said to have failed from age rather than wind or hail. Storm dates, close-up photos, test squares and nearby damage reports help show what actually happened.

Wildfire smoke and ash

Smoke and ash can get into HVAC systems, insulation and soft goods even when a home doesn’t burn. Testing and a room-by-room cleaning scope help document it.

Frozen and burst pipes

Freeze claims often turn on whether heat was maintained and where the pipe broke. Keep utility bills, thermostat records and the plumber’s written report on the cause.

Contents left out

Furniture, flooring, appliances and personal property are easy to undercount. A room-by-room inventory with photos, model numbers and receipts helps, and replacement cost policies may hold back depreciation until items are replaced.

Tip: Loop in your agent, but put it in writing

Your agent can help with paperwork, but the insurer’s claim staff decides the claim. Send important information to the insurer in writing, copy your agent, and keep copies.

What to do after a Acuity denial or low offer

    Request your policy right away

    A Colorado homeowner’s insurer must make a copy of your policy, with declarations and endorsements, available within 3 business days after you ask, and a certified copy within 30 calendar days after a written request to its registered agent (C.R.S. § 10-4-110.8(10)).

    Get the decision and the reasons in writing

    Ask for the specific policy provision the denial or reduction relies on, the adjuster’s estimate and any reports. Colorado law prohibits unreasonable delay or denial of covered benefits (C.R.S. § 10-3-1115); whether that applies is a legal question for an attorney.

    Know your contents and ALE rights

    After a total loss of a furnished primary home’s contents, insurers must offer at least 30% of the contents limit without an inventory and allow at least 365 days to submit one. Replacement-cost dwelling policies must include at least 12 months of ALE (C.R.S. § 10-4-110.8(6), (11)).

    Use the policy’s appraisal clause

    If the disagreement is about the amount of loss, the appraisal clause may resolve it without court. Read its exact steps and deadlines.

    Don’t rely on a shortened suit deadline

    A Colorado homeowner’s policy can’t require you to sue within a shorter time than the statute of limitations (C.R.S. § 10-4-110.8(12)). Ask a Colorado-licensed attorney about legal deadlines.

Hail hit my Colorado roof, but the estimate covers only part of it. What now?

Ask for the inspection photos and the estimate, then have the roof documented slope by slope: hits per test square, damaged vents and flashing, and whether matching shingles are available. Colorado law also gives you the right to a copy of your policy within 3 business days of asking.

Can a public adjuster help if I bought through an independent agent?

Yes. The agent placed the policy; the insurer’s adjuster decides the claim. We work only for you and handle the documentation, estimate and negotiation.

Nearby wildfire smoke got into my home. Is that a claim?

It can be, even when flames never reached the house. Document odor, soot, HVAC filters and ash in the attic or vents, and ask what cleaning or testing protocol the estimate is based on.

How do I get a copy of my policy in Colorado?

Ask your insurer. Under C.R.S. § 10-4-110.8(10), a homeowner’s insurer must make a copy of your policy, including the declarations page and endorsements, available within 3 business days after you request it, and a certified copy within 30 calendar days after a written request to its registered agent.
